Terms of Service

These Terms of Service ("Terms") govern your access to and use of Rowen, a form backend service operated by Nikhil Nagar ("we," "us," or "our") and available at rowen.in. By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Service Description

Rowen provides a form backend as a service. You create form endpoints through our platform, point your HTML or JavaScript forms to those endpoints, and we handle receiving, storing, filtering, and forwarding the resulting submissions. Our service includes spam protection, email notifications, a submission management dashboard, file upload handling, and integrations with third-party services such as Google Sheets and webhooks.

2. Account Responsibilities

You are responsible for maintaining the security of your account. This includes:

• Keeping your login credentials confidential and not sharing them with unauthorized parties.
• Ensuring that only authorized individuals have access to your account.
• Promptly notifying us at Nikhiln8885@gmail.com if you suspect unauthorized access to your account.
• Providing accurate and complete information when creating your account and keeping it up to date.

You are responsible for all activity that occurs under your account, whether or not you authorized that activity.

3. Acceptable Use

You agree to use Rowen only for lawful purposes and in compliance with these Terms. You must not:

• Use Rowen endpoints to send, distribute, or facilitate unsolicited bulk email (spam) or any form of unwanted commercial messaging.
• Submit, collect, or store illegal, defamatory, obscene, or otherwise harmful content through our service.
• Attempt to overwhelm, disrupt, or degrade the service through automated abuse, denial-of-service attacks, or excessive programmatic requests to form endpoints.
• Use the service to collect personal data from individuals without their knowledge or consent, or in violation of applicable privacy laws.
• Reverse-engineer, decompile, or attempt to extract the source code of Rowen's proprietary systems.
• Resell, redistribute, or white-label the Rowen service without our prior written consent.
• Use Rowen to facilitate phishing, credential harvesting, or any other fraudulent activity.

We reserve the right to suspend or terminate accounts that violate these restrictions, with or without prior notice depending on the severity of the violation.

4. Plans, Limits, and Billing

Free Tier

Rowen offers a free tier that allows you to use the service with certain usage limits. The free tier is provided as-is, with no guaranteed service level or uptime commitment.

Paid Plans

Paid plans provide higher usage limits and additional features. Plan details and pricing are available on our pricing page. Paid subscriptions are billed on a monthly basis. You may upgrade or downgrade your plan at any time; changes take effect at the start of your next billing cycle.

Usage Limits

Each plan has defined limits for submissions per month, number of forms, and file upload sizes. If you exceed your plan's submission limit, we will continue to capture submissions during a 72-hour grace period and notify you to upgrade. After the grace period, additional submissions may be rejected until you upgrade or a new billing cycle begins.

Pricing Changes

We may change our pricing with at least 30 days' advance notice. Price changes will not apply retroactively and will take effect at the start of your next billing cycle after the notice period.

5. Intellectual Property

Your Data

You retain full ownership of all data you submit to or collect through Rowen, including form submission data, uploaded files, and account information. We do not claim any intellectual property rights over your content. We access your data only to provide the service, as described in our Privacy Policy.

Our Platform

The Rowen platform, including its design, code, features, documentation, brand, and all related intellectual property, is owned by us. These Terms do not grant you any rights to use our trademarks, logos, or brand assets except as necessary to identify the service in connection with your permitted use.

6. Service Availability

We strive to maintain high availability and have designed our infrastructure for reliability. However, we provide the service on a best-effort basis. We do not offer a formal Service Level Agreement (SLA) for the free tier. Paid plans may include availability commitments as specified in the plan terms.

We may occasionally need to interrupt the service for maintenance, updates, or infrastructure changes. When possible, we will provide advance notice of planned downtime. We are not liable for any damages resulting from service interruptions or downtime.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Rowen and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the service.

Our total aggregate liability for any claims arising from or related to these Terms or the service shall not exceed the amount you have paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty US dollars ($50), whichever is greater.

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Indemnification

You agree to indemnify and hold harmless Rowen and its operator from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of a third party.

9. Termination

By You

You may delete your account at any time from your Rowen dashboard. Upon deletion, all your data including forms, submissions, and uploaded files will be permanently removed from our active systems. Backups may retain your data for up to 30 days before being purged.

By Us

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if we are required to do so by law. For non-critical violations, we will attempt to notify you and provide a reasonable opportunity to remedy the issue before termination. For severe violations (such as using the service for illegal activity, phishing, or attacks on our infrastructure), we may terminate access immediately without prior notice.

Effect of Termination

Upon termination, your right to access the service ceases immediately. We are not obligated to retain your data after termination, though we will make reasonable efforts to allow you to export your data before account deletion takes effect, except in cases of immediate termination for severe violations.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India.

11. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on our website at least 15 days before the changes take effect. Your continued use of Rowen after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree with the updated Terms, you should stop using the service and delete your account.
